      Teen From Fatal Hit and Run Sentenced to Probation

      OMAHA (KPTM) - An Omaha teen who hit and killed a man with her car and drove away was sentenced to probation in juvenile court Tuesday afternoon.

      17-year-old Mikala Rinehart was first charged as an adult with felony for leaving the scene of an accident resulting in death last September.

      She was driving near 42nd and H streets on September 7th when she hit 64-year-old Frank Huerta, who was crossing the street. Rinehart told her mother she thought she hit something, but didn't see what it was and drove away.

      "The judge had a difference of opinion, and sent the case to juvenile court," Douglas County Attorney Don Kleine continued. "It's definitely a sentence you can anticipate in juvenile court for this kind of situation."

      She was given therapy and 100 hours of community service.

      It was an emotional day for the Huerta family.

      "The judge gave more sympathy to the girl that killed our father versus us," Huerta's daughter Diane Nunez said.

      At the time, police said Huerta's Blood Alcohol Content (BAC) was four times the legal limit.

      There is no time limit when Rinehart will be off probation.

      The family says there will never be a time they don't feel the pain from their loss.

      "It's been hard not being able to go down to his house, have dinner with him, to call him on the phone," Nunez said.
