Infant dies as a result of child abuse, police say


OMAHA, Neb. (FOX42 KPTM)-- An Omaha woman is accused of abusing a newborn baby so badly they died.

Officers say they were called to check on an unresponsive child on March 15th around 3:30 in the morning.

Police talked to parents who were with the five-month-old-infant, Justice Layton, at the home and at the hospital to piece together what happened.

After information came in from the hospital, police say they determined the infant's injuries were a result of child abuse. At that time Ashley Newburn, Layton's mother, was arrested on child abuse charges.

On March 17th, Layton died and the Douglas County Attorney upgraded Newburn's charge to Felony Child Abuse resulting in Death.

Court documents say Newburn told detectives she was alone with Layton when he got his first injury while the rest of the family was asleep.

They also say she told detectives she was there, awake, and alone with Layton and did notice him stop breathing and go limp, but refused to tell them what caused it.

Her bond was set at $100,000, she will be back in court in April.
