A man accused in the murder of a Lincoln woman appeared in district court on Monday in Wilber.

Aubrey Trail, 51, faces charges of first-degree murder and Improper disposal of human skeletal remains in the death of 24-year-old Sydney Loofe.

Trail's defense attorney, Joseph Murray, filed three motions at Monday's hearing.

The first asked the court to allow the defendant to take witness depositions to include as evidence in the case.

Those witnesses will be interviewed on Sept. 19 and 20.

Murray also filed a motion to hire a private investigator at a maximum cost of $10,000, and asked that the court release documents regarding the investigation and information gathered from the search warrant.

23-year-old Bailey Boswell is also facing the same charges.

She filed a motion to declare certain parts of the Nebraska death penalty unconstitutional. A hearing on the motion will be held at 10:30 a.m. Sept. 17.
